Imperial Parking Canada Corporation (together with its subsidiaries, affiliates, successors and assigns, “Impark”, “our”, “us” or “we”) prides itself on customer parking experience. Our Impark Now website (“Site”) and related products, services, content and features (collectively, the “Services”) enable users to locate, see the potential availability of, and reserve and pay for, parking spots at select parking facilities in Canada (each, a “Facility” and collectively, the “Facilities”).
The purpose of this Privacy Notice (the “Notice”) is to provide you (collectively, “user”, “you”, or “your”) with information about how Impark collects, uses, retains, shares and discloses your personal information in connection with the Site and Services. We are committed to protecting your privacy and will manage your Personal Information in accordance with the Personal Information Protection and Electronic Documents Act (Canada) and all applicable provincial, federal and international laws and regulations. By accessing or using the Site or Services, you indicate your understanding of and consent to our collection, use, disclosure, sharing, and retention of your Personal Information, subject to the terms of this Notice. If you do not consent to the collection, use, and sharing of your Personal Information as described in this Notice, do not use our Site or Services or provide us with such Personal Information.
This Notice also describes the rights and choices you have regarding your Personal Information. In some circumstances, at the time of collection of your Personal Information, we may provide you with additional information regarding our handling of your Personal Information.
Impark reserves the right to revise this Notice at any time. If we make any revisions, we will notify you by posting the revised Notice on the site and, in some cases, we may provide you with additional notice such as by adding a statement to our homepage or sending you an email notification. Your continued access and use of the Site or Services will be treated as your acceptance of the Notice in force at the time you use the Site or Services.
1. Consent
We will obtain consent regarding the collection, use and disclosure of your Personal Information as required by law. Generally, consent will be obtained before or at the same time we collect the information. In determining the appropriate form of consent, we will consider the sensitivity of the Personal Information and the reasonable expectations of the individual. We will get your explicit consent to process special categories of Personal Information. In some cases, we may seek your consent for the use and disclosure of your Personal Information after it has been collected, but before it has been used or disclosed. We will not use or disclose your Personal Information for any new purpose without first identifying the new purpose and providing notice to you or obtaining your consent (as applicable), unless otherwise permitted by law. You can always choose not to provide Impark with certain requested Personal Information, but then you may not be able to access or use all or part of the Site or Services.
2. Application of this Privacy Notice
This Notice only applies to the information that we collect, use, share, disclose or retain through your access to and use of the Site or Services. The Site or Services may contain access or links to services, features and content that are provided by third parties (the “Third Party Services”) that are not controlled or operated by us. The Third Party Services are maintained by third parties who have their own privacy policies and their own terms and conditions of use. This Notice does not apply to any of the Third Party Services and we are not responsible for any information disclosed to or collected by those Third Party Services or for the privacy practices of any operators or sponsors of the Third Party Services. The fact that we provide access or links to such Third Party Services is not an endorsement, authorization or representation of our affiliation with that third party. Since we cannot control the activities of third parties, we do not accept responsibility for any use of your information by such third parties, and we do not guarantee that they will adhere to the same privacy and security practices as us. To determine how your information will be treated when accessing or using the Third Party Services, you must read the privacy policy, if any, that applies to each of the Third Party Services.
3. Collection of Personal Information
“Personal Information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with you or a particular person or household, including any “Personal Information” as such term is defined in applicable provincial and federal privacy legislation.
Impark may collect the following types of Personal Information from users when they access or use the Site or Services:
- Account and Profile Information: We collect your Personal Information when you access or use the Site or Services or register for, create or modify an account with us (“Account”), which may include your first and last name, user name, address, email address, phone number, vehicle make, model and colour, license plate number and password.
- User Payment Information: We collect payment information directly from users. We use a third-party service provider and payment processor to handle payments for us, and they will receive your credit card information when you add it to through the Site or Services or your Account.
- Contact information: We collect your Personal Information when you contact Impark directly to inquire about the Site or Services, which may include your first and last name, email address, phone number and other information that you choose to provide to us.
- Other information: We collect Personal Information, which may include parking preferences and requirements and any other information you choose to provide, when you submit or communicate other Personal Information to Impark.
- Where Permitted by Law: We may also collect information, including Personal Information and transaction records, as otherwise permitted by law.
We may also collect the following Personal Information automatically when you use the Site or Services:
- Device Information: We collect information about the computer or mobile device you use to access or use our Site or Services, including your IP address, web browser type, hardware model, operating system of your computer or mobile device, mobile device carrier and manufacturer, and your mobile device identifier (e.g. IMEI numbers). We use device information to understand traffic and activity and to enable us to improve the Site or Services. For example, this information helps us understand whether the Site or Services are compatible with your mobile device.
- Technical and usage information: We collect information about your use of the Site and Services, including the sections of the Site and Services that you visit, the date and time of your use of the Site and Services, your actions within the Site and Services, crashes and other system activity, the website or source that linked or referred you to the Site, the URLs you visited before and after using the Site and Services, and certain content that you download from the Site and Services. We collect this data in an aggregate format for a number of reasons, including to understand the traffic on our Site and Services, how the Site and Services are used, and how we can improve them. We also collect this data to ensure that the Site and Services are compatible with your device.
- Cookies: We may also use “cookies” or similar technologies (small amounts of data that are stored on your computer’s hard drive, mobile device or media system platform when you use or access our Site and Services that identify your computer, mobile device or media system platform and may store information about you such as behavioural data). You can manage your cookie preferences at any time by selecting “Cookie Settings” at the bottom of the Site or on the cookie banner when you first enter the Site. However, please be aware that some of our Site and Services will not function properly if you do so and you may lose access to Site and Services you purchased. Unless you have adjusted your “Cookie Settings” so that it will refuse cookies, our system will issue cookies when you direct your browser to any website used as part of the Site and Services.
- Google Analytics. We use Google Analytics, a web analytics service provided by Google LLC (“Google”), to help us understand how visitors engage with our Site and to improve our content and Services. Google Analytics uses cookies and similar technologies to collect information about your interactions with our Site and Services. This may include details such as your IP address, browser type, operating system, device information, referring URLs, and the pages you visit on our Site. The information generated by these cookies is transmitted to and stored by Google on servers that may be located outside Canada, including in the United States. Google uses this information on our behalf to evaluate your use of the Site. We do not use Google Analytics to collect any information that personally identifies you, and we do not merge the information collected through Google Analytics with personal information without your express consent. You can choose to opt out of Google Analytics by installing the Google Analytics Opt-Out Browser Add-on. The information we collect may reside in servers located in the United States or Canada. By accessing or using the Services or otherwise providing information to us, you consent to the access, processing, storage and transfer of information in and to the United States, Canada and other countries where you may not have the same rights and protections as you do under local law.
4. Use of Personal Information
In addition to the specific uses above, we will also use the Personal Information we collect for the following purposes:
- to set up and manage your user profile or Account with us;
- to give you access to the Site and Services and related features, or to restrict your access;
- to communicate with you, including via our chat function;
- to improve our Site and Services, and to inform the creation of future Services;
- to conduct data analysis, testing, research, and monitor and analyze usage and activity trends;
- to provide technical support or customer service;
- to ensure compliance with and identify violations of our Terms and Conditions of Use;
- to identify and prevent fraudulent activity and to protect the integrity, safety and security of Impark and the Site and Services;
- to personalize and improve the Site and Services and provide advertisements, content or features that match user profiles or interests and facilitate contests or promotions (if you choose to allow that function);
- to meet legal and regulatory requirements; and
- to facilitate such other services and activities, as we may identify at the time.
If you provide us with your e-mail address and “opt-in” to receiving marketing messages from us via the e-mail address provided, you may receive electronic communications from us from time to time. These electronic communications will provide you with our contact information and a method to unsubscribe from receiving marketing information and/or any further communications from us. You can also opt-out of receiving further communications from us by contacting the Chief Privacy Officer at the details below. We will use your e-mail address to communicate with you regarding important matters, such as information about your Account. You may not opt-out of receiving communications required by law, or necessary to provide you with requested Services.
By providing Personal Information through the access to or use of the Site and Services, you acknowledge and agree that we may use the Personal Information for the purposes set out in this Notice, and by accessing or using the Site and Services, you also agree that we may use non-personal information for the purposes set out in this Notice. We will only use your Personal Information the purpose for which it was originally collected, or for a use consistent with that purpose, unless you expressly consent otherwise or it is permitted or required by law.
5. Disclosure of Your Personal Information
Except as described in this Notice or in other situations where we have provided you with prior notice, have obtained your consent, or are obligated or permitted by law, Impark will not share your Personal Information with third parties.
We may disclose certain Personal Information to our employees, affiliates, contractors and consultants. We may disclose certain Personal Information to third party service providers with whom we have contracted to provide certain services on behalf of Impark, such as payment processors and cloud service providers, and as a result, your Personal Information may be collected, used, processed, stored and disclosed in Canada or other jurisdictions, including the United States, where it may be subject to the laws of that jurisdiction, including laws regarding the disclosure of Personal Information to government authorities. Currently, Impark uses a third-party service provider, Intellipark, LLC, to host and maintain the Site and Services and for support and maintenance services in connection with the Site and Services. The third party service providers will have access to Personal Information needed to perform their functions, but are only provided the limited amount of Personal Information required to perform their services. When Impark uses third party service providers, it requires the providers to protect your Personal Information in accordance with the law and with the same or more stringent security and privacy standards than Impark. Any such disclosure of your Personal Information by Impark to a third party service provider will be conditional upon the Personal Information being used solely for the purpose for which it has been disclosed.
In addition, we may also disclose certain Personal Information with Facility owners, operators and administrators to the extent required to manage the Facilities where you park, to deliver services that you use and to provide you with advertisements, content or features applicable to such Facilities.
We may also disclose users’ Personal Information in connection with a corporate re-organization, a merger or amalgamation with another entity, or a sale of all or a substantial portion of our assets provided that the information disclosed continues to be used for the purposes permitted by this Notice by the entity acquiring the information.
Impark may also disclose your Personal Information where permitted or required by applicable law or regulatory requirements. For example, we may disclose your Personal Information to comply with a subpoena, in response to a law enforcement body with the lawful authority to obtain the information, pursuant to an investigation into the breach of a law, or to our legal counsel.
6. Security and Protection of Your Personal Information
We follow industry standards for protecting Personal Information and use commercially reasonable administrative, physical and technical safeguards appropriate to the sensitivity of the Personal Information. However, while we attempt to ensure the integrity and security of our network and systems, we cannot guarantee that our security measures will prevent third-party “hackers” from illegally obtaining access to this information. No method of transmission over the Internet, or method of electronic storage, is 100% secure, so the use of the Site and Services is at your own risk. We are not responsible for any failure by you to secure your own devices and their access to the Internet or your use of public, unsecured networks. In addition to the security measures referenced above, if you use the Site or Services, you are responsible for maintaining the confidentiality of your Account and for restricting access to your device, and you agree to accept responsibility for all activities that occur under your Account.
Impark will use care when destroying or disposing of Personal Information to prevent unauthorized access, use or disclosure of any Personal Information. Our employees, contractors and third party service providers with access to Personal Information are required to respect the confidentiality of such information.
7. Retention of Your Personal Information
Information collected by Impark is maintained in accordance with applicable privacy legislation and Impark’s retention policies and practices. We retain your information after you have closed or stopped using the Site and Services in accordance with the law as long as reasonably necessary for identified purposes. Afterwards, we will securely delete or anonymize your information. If you request deletion of your Personal Information, we will delete or anonymize it except for purposes reasonably required for legitimate business purposes or as otherwise legally permitted or required, such as for maintaining the Site or Services, operating our organization, complying with our legal obligations, resolving disputes, and for safety, security, and fraud prevention. This means that we consider our legal and business obligations, potential risks of harm, and nature of the information when deciding how long to retain Personal Information.
8. Correction and Access to Your Personal Information
All Personal Information in your Account and user profile is accessible by the User. You can make changes to certain Personal Information that Impark holds about you, such as your contact information, by editing the information in your Account. You are responsible for keeping the Personal Information in your Account up to date and accurate.
You can challenge the accuracy and completeness of your Personal Information in the possession and control of Impark. In appropriate circumstances, Impark will amend the information. It is your responsibility to provide any updates to your Personal Information to us in writing at privacy@reimaginedparking.com.
You have a right to request access to or correction of your Personal Information. To do so, you may contact our Chief Privacy Officer or submit a request through our privacy webform in Section 10 below, with sufficient detail to enable us to identify the Personal Information being sought. When you contact us, we may ask for further information to confirm your identity and the nature of the information being sought.
After we receive your request for access to Personal Information, we will provide you with an estimate of when you can expect a response, but this will be no later than 30 days. In some cases, we may need additional time to respond to a request, in which case we will provide you with written notice of the extension. Please note that in some cases, we may not provide access to Personal Information that we hold about you, such as where the denial of access is authorized by law. There are also cases where we may be legally required to refuse access to Personal Information. If we deny your request for access to Personal Information, we will advise you of the reason for the refusal, and will provide the name, title, and contact information of the designated person who can address the refusal.
9. Governing Law
This Notice shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of laws principles.

Impark takes any complaint about our privacy practices seriously. We will investigate all complaints. If we find a complaint justified, we will take the necessary steps to resolve it. The complainant will be informed of the outcome of the investigation regarding any complaint.
